South Carolina's Agency and Representation Model

South Carolina recognizes several agency relationships, including representing the seller, the buyer, or acting as a transaction broker who facilitates a deal without representing either party. Dual agency, where a firm represents both buyer and seller in the same transaction, is permitted only with the informed written consent of both parties. Because the state does not impose default fiduciary duties without an agreement, licensees must clearly establish and document whom they represent at the start of the relationship.
