Florida's Default Transaction Broker Agency Model

Florida law presumes that a licensee works as a transaction broker unless a different relationship is established in writing. A transaction broker provides limited representation to a buyer, seller, or both, but does not owe the full fiduciary duties of a single agent and instead works to facilitate the transaction with honesty and fair dealing. Licensees may also act as single agents or in no-brokerage relationships, but because transaction brokerage is the default, the prior requirement to give consumers a transaction broker disclosure was eliminated.
