Disclosures Georgia Sellers and Licensees Must Make

Georgia follows a caveat emptor (buyer beware) tradition, but sellers and licensees still must not actively conceal known material defects or make false statements about the property. Under BRRETA, licensees are required to disclose to all parties any material adverse facts they know about the physical condition of the property that could not be discovered through a reasonable inspection. Licensees must also disclose their agency relationship and whom they represent, and Georgia law requires compliance with federal disclosures such as the lead-based paint disclosure for homes built before 1978.
