Arizona's Agency and Representation Model

In Arizona, a licensee acts as an agent who owes fiduciary duties (loyalty, obedience, disclosure, confidentiality, accounting, and reasonable care) to the client they represent, whether that is the seller or the buyer. Agency in Arizona is created by a written agreement, and the brokerage relationship must be disclosed in writing. Because a salesperson's license is held by the employing broker, the agency relationship legally runs through the brokerage rather than the individual agent.
