OLD CAR: The 6 Fiduciary Duties Every Agent Must Know
Agency questions dominate the exam, and most reduce to the six fiduciary duties — OLD CAR:
O — Obedience: follow the client's LAWFUL instructions only. Told to hide a defect? Refuse.
L — Loyalty: the client's interest above everyone's — including your own commission.
D — Disclosure: tell your client every material fact you know — including the other side's
motivation if you learn it.
C — Confidentiality: the client's secrets (price flexibility, urgency) stay secret — forever,
even after closing.
A — Accounting: safeguard money and documents; never commingle client funds.
R — Reasonable care: competence and diligence; refer out what you're not qualified for.
The trap the exam sets
Duties flow to the CLIENT. Customers (the unrepresented side) get honesty and material-fact disclosure about
the property — but no loyalty, no advice, no confidentiality. Mixing these up is the most common agency miss.
